thewav respects copyright and complies with the Digital Millennium Copyright Act (DMCA). This page explains how to report infringing content and how we handle those reports.

1. filing a takedown notice

If you believe content on thewav infringes your copyright, send a written notice to our designated DMCA agent (see contact info below) that includes:

  1. A physical or electronic signature of the copyright owner or someone authorized to act on their behalf.
  2. Identification of the copyrighted work you claim is infringed (or a representative list, if multiple works are involved).
  3. Identification of the material you claim is infringing, and information reasonably sufficient for us to locate it (e.g., a direct URL/link on thewav).
  4. Your contact information — name, address, phone number, and email address.
  5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Incomplete notices may delay processing. We may remove or disable access to the reported material without prior notice to the user who posted it, consistent with the DMCA.

2. counter-notice

If your content was removed and you believe it was removed in error or misidentification, you can file a counter-notice with the same DMCA agent. Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal district court for your district (or, if outside the US, any district where thewav may be found), and that you’ll accept service of process from the person who filed the original takedown notice.

If we receive a valid counter-notice, we’ll forward it to the original complainant. Unless they notify us that they’ve filed a court action seeking to restrain the user from the infringing activity, we may restore the content in 10–14 business days, per the DMCA.

3. repeat-infringer termination

thewav terminates, in appropriate circumstances, the accounts of users who are repeat infringers. We track valid takedown notices per account. Multiple substantiated claims against the same account will result in content removal escalating to account suspension and, ultimately, permanent termination — consistent with our terms of service.

Knowingly filing a false takedown or counter-notice can expose you to liability, including for damages and attorney’s fees.
